    Err, I hope some people don't think that the lawsuit win means that copyright infringement will be in Youtube's blind spot. Copyright infringement will continue to be an extremely important factor for content management, ESPECIALLY after this amazing win.

    SWEET! This is such GREAT news! I have never understood why media copyright entities have been so hidebound on consumer hostility: always trying to control consumer activity, creating a black market, and then suing 12 year olds because the corp execs too lazy and self-entitled to do the job of responding to consumer driven markets.

    This is just a rights holder using the court system to rewrite a already one-sided law. The Digital Millenium Copyright Act is an example of corporate lobby influenced law written to protect corporate interest at the expense of our tax dollars so it doesn't affect their ability to increase their profits even more. YouTube has taken great strides in recent years to prevent infringing work from residing on their site as much as they can.

    This lawsuit was nothing more than a effort to rake in more money using the claim of infringing work. Too much now, rights holders are using this claim to increase their profits by taking people to court (among other things). To prevent this from continuing, the DMCA needs to be repealed and start over with legislation that works.

    One problem with DMCA is that it legally endorses Digital Restrictions Management (DRM).

    One thing that many people don't realize is, DRM is NOT about piracy -- it is about giving companies control over your use of their products. Companies are taking advantage of the issue of piracy and using it as an excuse to make their products use DRM, even when they routinely use DRM for purposes that are not even remotely related to preventing piracy.

    To all those who think that this now means you can upload Viacom-owned content and not have it taken down: It doesn't.

    What it means is that Viacom can't sue YouTube for allowing copyright infringement to take place, *as long as* YouTube continues to comply with the DMCA and disable videos subject to a claim pending the outcome of any counter claim.

    In other words: Viacom can still order YouTube to take your videos down. They just can't sue YouTube, that's all.

    In Germany and the rest of Europe the case most likely would have had a different result.

    Here after noticing an infringement, the platform provider has a duty to monitor the website in the technical possible way, to prevent infringements, that are substantially the same ("kerngleich") to the ones the platform provider has knowledge of.

    yes i do see that there are two sides to the reposting of content..things 95 % of the people on the internet NEVER see or even think about...but getting a taste of something beyound their daily world can make for a NEW audence..if i were making a special video using something from the past i would be very happy to say where it came from.maybe you could post that on your site where they could buy the whole thing...the world is a big place an using the net should not be done with a lawyer by your side

    ......used to be...that millions were spent to get a product out THERE to people who would never see or hear about it.... i used to go to the food show..the young son of one of the vendors was so proud of how much he saved his dad who was in europe on a buying trip..he told his father...yep we saved a heck of a lot..we did not give away those free samples... john locke lyric pines

    Hey, MOST GLAD to read of THIS news...I'd seen Ray's comment on the GAC/TTTP forums..and it's dumb that Viacom would go after home movies [as was already well known throughout the YouTube community!]. I can understand their own self protection but they did take a lot of..well, the others here and reading can just go to YouTube or look at the news themselves!!

    ....... john locke ... have had years of happynes shareing jewels from my past .. there must be a way of posting again without a lawyer sitting by my side... looking at what is being posted out there falls UNDER the CLOUD .. so i do not understand .. YUP IF IT is COPYWRITED...da da do not use it ...spend 5 hours for a 2 minute piece to ..MAYBE ..see if somebody has GRABED a piece of it..there has to be a better way to keep everybody happy right now .. if i grab a 1903 recording an use it..there might be somebody coming after me..the wonderful createive freedom of the net is over for me..... god does anybody have an answer.....an yes i have found SOME things but trying to make them FIT into the project is DULLING....an then is it really legal.... johm locke
