Err, I hope some people don't think that the lawsuit win means that copyright infringement will be in Youtube's blind spot. Copyright infringement will continue to be an extremely important factor for content management, ESPECIALLY after this amazing win.
SWEET! This is such GREAT news! I have never understood why media copyright entities have been so hidebound on consumer hostility: always trying to control consumer activity, creating a black market, and then suing 12 year olds because the corp execs too lazy and self-entitled to do the job of responding to consumer driven markets.
This is just a rights holder using the court system to rewrite a already one-sided law. The Digital Millenium Copyright Act is an example of corporate lobby influenced law written to protect corporate interest at the expense of our tax dollars so it doesn't affect their ability to increase their profits even more. YouTube has taken great strides in recent years to prevent infringing work from residing on their site as much as they can.
This lawsuit was nothing more than a effort to rake in more money using the claim of infringing work. Too much now, rights holders are using this claim to increase their profits by taking people to court (among other things). To prevent this from continuing, the DMCA needs to be repealed and start over with legislation that works.
One problem with DMCA is that it legally endorses Digital Restrictions Management (DRM).
One thing that many people don't realize is, DRM is NOT about piracy -- it is about giving companies control over your use of their products. Companies are taking advantage of the issue of piracy and using it as an excuse to make their products use DRM, even when they routinely use DRM for purposes that are not even remotely related to preventing piracy.
Youtube for the win. Now you can get back to watching all those Partner apps. I'm going on 4 months. Throw a brother a bone or at least issue us app numbers we can log in and see where we stand.
Good news - lets just hope that all those 15yr olds don't think this gives free rein to copyright infringement - if anything YT will be even stricter in enforcing the laws!

What it means is that Viacom can't sue YouTube for allowing copyright infringement to take place, *as long as* YouTube continues to comply with the DMCA and disable videos subject to a claim pending the outcome of any counter claim.
In other words: Viacom can still order YouTube to take your videos down. They just can't sue YouTube, that's all.

Here after noticing an infringement, the platform provider has a duty to monitor the website in the technical possible way, to prevent infringements, that are substantially the same ("kerngleich") to the ones the platform provider has knowledge of.

Someone should repeal against the DMCA because it stinks and is not working at all. Torrents have copyright on MOST of their torrents and do you see anyone removing them? NO so what's the problem with streaming video?

....... john locke ... have had years of happynes shareing jewels from my past .. there must be a way of posting again without a lawyer sitting by my side... looking at what is being posted out there falls UNDER the CLOUD .. so i do not understand ..
