    Its very cool that Youtube is considering different methods for Youtubers to use music in their backgrounds. I would recommend a video with more information on this topic too. This way, those in the future that get their videos removed can view the video for more info. It would be great in the future if Youtube allowed a music track that can be added at Audioswap that doesnt remove the original sound but is an addition. Secondly, it would be a good idea to let the marketing staff talk to major record companies will early release songs and see if their songs can be used in our videos. Its a form of free advertisement. We could also have a choice of another song so when the time frame for that original song has ran out. They could pay to have this because every time a new song is being used, an icon for an Ad could be automatically applied. I also think its great and I have written Youtube about this but get the word out that certain artists are allowing certain songs to be used here. If the list was compiled and listed by genre that would also help and could be marketed as Artists Shared Music. Just a thought. ~Regards, Raven

    Part 2~ To add,--- record companies or new artists desire to get the music heard. Youtube could charge for this and Youtubers could use their music in their videos as well as a link that viewers could click on to buy the song. If you make it where the songs have a time constraint, example-3months,...then when the Youtuber goes to use this song, they ALSO have an option to add another song for when the time runs out. This gives the record companies opportunities to get their song out especially for new artists. ~Regards, Raven

    Thanks for posting this. It really means a lot to us users that you understand why we are upset about it. But you are right, it is all up to the record label. Hopefully in the future, major labels like UMG and Hollywood records can use this as free advertising. Maybe by putting an ad for the artist/label beside the video so they earn revenue from it.

    This is Bull Shit. Youtube is making money off things the way they are and will keep doing so until they are shut down. The music and entertainment industry is rightfully angry because they can't sell what they own when people on youtube are giving their property away for free.

    Type in "Copyright infringement" and you will get 160,000 hits. Almost all are illegal. One site says "No copyright infringement intended. Columbia pictures owns the rights to these films. I upload them so people can watch the movies for free" You think the studios are not going to fight back?

    With Youtube ignoring their own guidelines it is only a matter of time before the courts shut them down. Just like Napster.

    By the way, I want to make it clear that I don't necessarily agree that they should be shut down, and coming to money agreements with the artists might be a step in the right direction, but unless they do more than just ignore the copyright abuse going on, they are going to have a tough legal fight on their hands. They have rules for their members, but you have to look hard to find them.

    There are still a bit of misunderstandings with the Content ID Program. While I know that UMG often places advertising on videos that use their music, it still seems that quite a few of UMG's music gets blocked. Not even the music in AudioSwap is a sign of what music is ok to use, because I've heard that some videos have been blocked for using copyrighted music, but the track was available in AudioSwap.

    what about if the music owners don't have a youtube channel to show proof of copyright. i have some songs that i dont own in my videos but thats because i checked to see if the artist or company had a channel that could mark me for copyright material in my videos but they dont so....

    Hello Dawn,I just read your article about Warner and Youtube and feel very disapointed.These videos are free addversitising for the artists.I paid over $250.00 to see the Rolling Stones for each ticket {X4}.How much money do these people want,are they really lacking that they have to charge for something that BOUNTY pays for?Or any other advertiser we see commersials for on T.V.Since they pay for the slot on the tele then they should pay for the slot on Youtube,hell its not like they a`int got it like that.And besides its the live shows where they make the real money,why should they make money when they are sitting in a lounge chair at some resort drinking a mai-tai.The video`s and audio`s are their advertising.

    unfortunately, starving artists cant get by with the PENNIES they get as royalties from these BEHEMOTH corporations. greed has its own special life, residing in the hearts of ignorant business people who never feel hunger. rather than pay the performer, listeners are actually sending 95 percent of the purchase price to people who leech a living from the true artists. just like the old gangs of the past, studios are criminals and liars, protected by legions of leechy lawyers. if the perfomer isnt in front of me, i dont buy, listen or care about their message.

    It is not "good publicity" for them.

    No, you are stealing their work. Youtube says "Broadcast yourself". Not others. If they want publicity, it is up to them to get it. Not you.

    If a concert or TV show is "broadcast" then all of those involved get royalties. Look at the rules here. they are being ignored.

    Here is an example:
    Youtube user "goonietastic" ET is still for sale for $10. This guy is giving it away. That is why they are mad. He owes someone $400,000.

    Once again, the music labels miss the point completely: This is fan-driven free advertising for them. It carries none of the fees(often quite substantial) it takes to get a video into rotation with MTV. It has a far bigger userbase. It creates a culture around the bands. That culture buys albums, tickets and swag.

    The biggest problems that the music industry faces today is that instead of getting their arms around the Internet, instead of thinking "How can we leverage this enthusiasm and this truly fan-based model" they are instead trying to wipe it out and sue the fans into the poor house.

    These are not the brightest bulbs in God's chandelier.

    I had recieved a notification from UMG over my use of their music (a song by Pavoratti) in one of my videos. Rather than take it down, they posted links to Itunes and Amazon for that song on my video's page.

    One has to wonder why the music industry hates it customers so much.

    Obviously, they have a right to protect their IPs, but at the same time, the group that is hurt the most by this isn't youtube, its the customers and fans who want to express themselves and give free (FREE) advertising to music industry my using their music in the videos they create.

    Some artists are signed to various labels in different countries. An artist might be signed to UMG in one country but also liscenced to WMG in another country hence why videos with content from other labels are being removed too.

    I can't beleave that a-ha's Take On Me video has been deleted. It had over 8 million views.Does Warner honestly beleave that this kind of behaviour will be positive for them and for the artists they represent ?

    In a world where recordlabel has become very selective in wich artists they chose to back up with their promotioanl machine, youtube is a positive thing for both artists, fans and yes recordlabels. Alot of free promotion wich is good for everyone.

    If you are adding music to a video that you have made/created, your work can be pulled because of copyrights - I just check out tribe of noise and there are no copyright problems now or in the future the musicians want you to use it, it was created under a special creative commons license your work would never get pulled it is really worth a look

    Warner, Sony BMG, EMI and Universal Music Group are in early phases of talks to have a separate music video service than YouTube, as the Google service is asking for more revenue share now.

    This has been a long time coming. And, is part of the evolution of the video web.

    I used to think of youtube as an entity that stands for freedom and sharing of information. Now i can t even watch my fav clips when i go back in my home country. What s up with this "not available in your country" bullshit???? Since when???

    I can't believe how many idiots there are when it comes to copyright law. YT isn't the one being greedy. They have to pay a fucking licensing fee to keep our videos active. Warner Music Group decided to be a greedy bastard and demand more. When they didn't get the amount they wanted or liked, they pulled out working with YT. Silly, ignorant users! YT has long come out as being on OUR side where access to music and movies is concerned.     I'm just looking for a place to lodge a complaint about YouTube since they've so helpfully have broken links on their "contact us" page.

    YouTube - why is it that every video I watch now has horrible ad layovers that block my video and that I can't easy close? I work in digital advertising so I get that you are selling some valuable real estate. But if you continue to ruin my user experience, this won't be a preferred site for me to visit anymore. IMPROVE YOUR AD LAYOVERS AND POP UPS!!!!! If you can't make sure that I have the option to easily close them, then remove them all together!!!!

    Ok, I understand the need to comply with the licensing agreements. I was given a notice of infringement and corrected it with the use of the Audio Swap feature. Now i have advertisements on my main page???? Also i can't sign in the my "account" tab as I get a warning from my Anti virus program (malicious program) what gives?

    I don't know what the most popular searches are, but I'm assuming that music related videos are high up there. YouTube knows that by not having an agreement with WB, both parties are losing a lot of money. YouTube needs to act QUICK before these big music companies start creating their own versions of YouTube, which they certainly can and probably will do. Not everyone, especially music corporations wants to be employed by Google, but at the moment, that's the best option there is (smart move by Universal) considering YouTube is one of the biggest websites on earth. Eventually, I see ALL of Universal's videos going to Hulu.com once their contract with YT expires. YouTube should cash in when the time is right, which is NOW. As far as Audioswap, I find it to be a horrible system (as most YT users would agree). I think you need a better development team to work on things like that. Users try Audioswap only to find out it's a failure with extreme limitations. Obviously, the only way to track the music being used on billions of videos being uploaded is to develop an amazing program which will ID each video. That would probably take hundreds of millions of dollars or maybe even a billion to develop. On top of that, it's nearly impossible to develop because when a track is used behind a vlogging voice, it makes it harder to "scan" what song is being used. Too crazy!!!

    I loved sending the videos via email with those lovely , beautiful Holiday Cards you provided just like ecards. I guess they were only for the Holidays whereas their no longer there. Would you please consider bringing them back with cards applicable for year round , birthdays,weddings,anniversary's,congratulatory,gradution,get well, humorous , wildlife/nature scenery

    They will be sued out of business if they don't do a lot more to advertise and enforce their own guide lines. Has anyone read them? Can anyone find them?

    They basically say BROADCAST YOURSELF. Not others or other peoples stuff. YOURSELF. Record something off the TV? You don't have the broadcast rights, can't use it. Sing or play a song YOU didn't write or was written after 1923? Sorry. It isn't yours. Record a public concert or performance with your camcorder? Illegal to "Broadcast" since it is copyrighted material. And movies and movie clips are the same.

    Doesn't leave much left. The problem is, other broadcast medium pay the artist for the material that is given away here for nothing. This makes it impossible for the owner to sell it. Wanting to get paid for your work isn't being "greedy"

    And this garbage about giving them "free publicity". If you own a car dealership and someone steals a car, they can't use the excuse, "I'm driving it around town, I'm giving you publicity" Same thing here.

    I don't want youtube shut down, but if they don't find away monitor what's going on and compensate those who are being ripped off, then their days are numbered.

    Go to the goonietastic site and see how blatant the violations are with nothing being done. These type of sites will kill YOUTUBE in the courts.

    I had two emails concerning my videos, What I'm fustrated greatly about is that I emphasize that the artist(s) were owners of that song(s), but it didn't seem enough, now whoever marked dispute claims now have access to the number of viewers I get, or add advertisements on the video. I hate to say it but Youtube isn't that kind of place it use to be... Read the comments, if you REALLY care about what the users think...

    I used to have over 100 tribute videos to soldiers, police officers, firemen, etc. now im down to 92 I lost one of my videos about a helf hour ago to content owners, what the hell is the point of adding more tributes to these people on youtube if all my videos keep getting smacked down by content owners even if i say their name and music title at the end of the video and in the discription. What the hell happend to youtube i miss the old youtube were you don't have to worry about content owners barging in and taking your videos away

    I think audioswap needs more categories. I realize the songs are broke down by genres. It would be helpful if there is a mood category. For example: If someone is looking for a song pertaining sadness it would be easier to find. All you would have to do is click on the mood your looking for and it will give a list of songs.

    My issues with copyright laws go way beyond what is happening here at You Tube.

    I have serious issues, for example, with record labels who feel the own the rights of a work ad infinitum. There are videos with music in them, music that was made 3-4 decades ago, that are being blocked by a 'copyright holder' even though they are no longer making the music available through commercial channels. The copyright laws need to be changed they stifle creativity and reduce who we are as a people to just a corporation's 'bottom line'. Our culture should not be held hostage like it is.

    Contact you representatives in government and let them know that the copyright laws need to be changed...

    YouTube knows that even though many people want to watch the Daily Show and South Park on YT, we can't, and so instead YT encourages users to develop quality content themselves, which we do. Just like with visual media, YT shouldn't be breaking its back to get permission from music studios for commercial music, but forming alliances with Creative Commons sites to encourage people to create and make available music content the same way it does for video content. I make sure all my music either has permission or CC licensing, and the added reward of discovering someone new that is just as good as a commercial artist adds to the satisfaction of making YT videos.

    By the way, I don't think I will ever use audioswap. It is a nice first step of getting companies used to using the music, but the inability to put the sound in with the video soundtrack (ie - having the music as BGM to ambient sounds or conversation), and the inability to handle the file directly to beatmatch or edit a file as a music vid makes it unuseable. I hope that it is part of a longer term strategy to secure licensing to allow users to download and use music for the sole purpose of inclusion, with proper credit, in fully edited videos for YouTube.

    So its obvious the record companies are just being greedy here. I mean, heaven forbid someone try to listen to a compressed, mono, incomplete, 40 year old Elvis song without paying!     i remember a time, before google buoght youtube when this was a place of freedom. we could post what we wanted with the contect we watned (no porn?nudity of course), but we could use all the resources we wanted for our creations. now, it a stepping stone trail across a lake of fire just to get a video that wont get pulled down, cause we looked at the screen wrong.

    Youtube is making some serious mistakes, and we pay for it. Pray to the gods another site doesnt come around and cripple this sorry excuse of a site

    Before, it was user content all over, now its riddled with corp/commercial garbage.

    It seems to me that You Tube should be putting more effort in shutting down some of these "trolling" and "clone" accounts, that are growing in numbers like weeds lately. This is supposed to be a video sharing site. However, there are many accounts set up by individuals whose sole purpose is for nothing else but to post hate, insults, grossouts, and (excuse the expression) overall shit slinging. I know of several individuals who had videos removed for this new music policy which had been up for over a year and were quality productions. I understand from some people trying to upload new clips that they expereienced frustration excessive time in getting the video to eventually post. The reasoning behind this whole issue is both confusing and unecessary. Your management should be more focused on increasing the financial bottom line. Irratating and discoraging people is not the way to do it.

    Youtube sirs, I think you should talk with the (excuse the expression) morons of Warner Music to let us put really good AMV's with great songs in your site.

    I think that AMV's are a free mode to promote a song, because they don't spend money in any videos, the fans make the videos putting their favorite songs in the videos.

    I think Warner and the other morons of the Music Recording Industries must be more worried about the piracy in countries like Mexico, not in AMV's that only promote "their products". (Note: I'm from Mexico, so I can assure that.)

    Why is Youtube refusing to allow users to file a DMCA counter claim for the music that has been removed? In some cases, the music was only playing in the background as someone was talking or dancing. In others only a short snippet (25 sec) or less was being used. Both are examples of fair use claims which all citizens have the right to assert.

    How does Youtube justify their failure to apply with the DMCA counter notice provisions? Is this going to be another example where the user base is going to sue Youtube to get them back into compliance with federal law?

    Fucking hell. Why do so many artists have to be so overdramatic about the use of their work? They're advertising your song, for one thing. For another, most programmers (including me) release the stuff they make for reuse, usually under very non restrictive terms. Music companies, however, shit their pants if someone has one of their songs as background music.

    Youtube seems to be perfectly fine with letting assholes flame other assholes, though. Has anyone on "The YouTube Team" ever read any of the text comments in a popular video? They're full of twits insulting other twits about meaningless things. Why don't you do something about that?

    I wanted to use a bit of copyright music as background for a short film to run on Youtube. I didn't realise at that point that a deal had been done with the PRS and contacted them myself offering to pay a licence fee. To put it mildly, they were a bit surprised I offered and had no mechanism for allowing that to happen.

    My only gripe about audio swap is it replaces the sound for your entire vid, if there was a way to only put the song in select parts of your vid that would be much better (Like the notations)

    I think Warner Music needs to consider the peripheral money making aspects to allowing Youtube users to use their artist's music. Please think laterally and not just a straight line down to the bottom line on their Youtube account balance sheet. Just think of some clips that have taken a back water song and made it a top 10 hit - there are a few that Youtube and it's uploaders can take credit for. Anyway I'm sure it will all be resolved soon - as Youtube is really the market leader by a long shot....a very long shot. They are an equal, if not a greater power than Warner Music - so let the strings loosen Warner please! Pretty please....

    The trouble I have believing this, is the fact that in experiences I've become aware of, (friends griping, my own, ect) is that there is NO warning before the video is taken down, any more. It is just pulled, and often times the maker is even unaware that it is gone for a period of time.

    It took me a week to finish a video I wanted to make for a long time. I worked really hard on it because I wanted to enter a contest here in youtube. It was EXTREMELY frustrating to find out that my video was taken down because of copyright infringement, I wish the audioswap option would work, but it just doesn't.... it is not the same creation. I understand that WMG is probably losing business because of YT, but they should understand that YT has grown significantly to be causing any kind of problems to its users.

    first of all audioswap is the dumbest idea ever. videos created around a song are ruined because the songs in the library don't fit the video both in length and meaning. i spent a lot of time making a video that i was proud of and i go to put it on youtube and guess what, no audio because the song is owned by WMG. do they not realize that when viewers like songs they go and buy them on itunes. that equals more money for them, but they can't see that because heads are stuck up their asses.

    My only gripe about audio swap is it replaces the sound for your entire vid, if there was a way to only put the song in select parts of your vid that would be much better (Like the notations) Copy and paste this if you agree, then there will be a better chance this is read. Cheers!

    As some people already said, what's the problem of putting up some commercial songs in Fan Videos? I made up a video about a game and I used some WMG songs, with due credit to the bands on the end of the video... So I'm kinda advertising for those songs and making them more popular. So if I ain't selling shit or making any commercial use of the video, exactly on the opposite, I'm advertising for that band/song, what's the problem of using it?

    Jesus Christ, solve this problem already, or Youtube will be going down the shithole.

    in my opinion the music company wont earn any money without "youtube" cuz youtube is one of the most favourite Web-Site, which most young ppls/teenagers and adults... are visiting and youtube is making a good promotion for the music company... so if they wanna check how is it that the music vids of them are gone from youtube so just test it but i dont think so that they would earn more money cuz youtube dont got the lisence for the music videos anymore...

    I think it's stupid how if you put a lot of effort into a video and use 30 seconds of a song the video gets pulled. This is dumb, because it's actually your original creation, and should not be removed just because there is 30 or more seconds of the audio.

    Chaoswarloch , Yt claims that no matter how many other vids with the same song are left, it's completely ok to them to pull down one certain vid which they set their eye on.
    to Yt: why are you pulling down the vids with songs that already ARE in audioswaps?I mean one vid with seether song. It's already in audioswaps section BUT the uploader got the music muted , moreover , she can't even swap the music.

    Yeah, I know it is completely ok to from a business standpoint. They own the website, so they should get to choose what they want on there and what they don't want. But from a moral standpoint, it is low of them to just remove some and not give equal treatment to different people.

    My clip "Mr. Bojangles" by Jerry Jeff Walker is taken from our "owned video", "The Arlo Guthrie Show." We have the rights to this show. However, from what I understand, WMG, just bought the publishing. What a shame, I don't think Jerry Jeff is going to like this. He had 85,000 views. I hope this problem can be resolved.

    First of all, the audioswap would be great if it actually had good music. Most of us make our videos to go with the original songs we use. It looks pretty stupid when you replace the audio with something that doesn't have anything to do with the video.

    Bull crap. Most people aren't enjoying YouTube. Youtube is going to hell in a hand basket. It shouldn't even be called "You"Tube anymore. More like "WMG"Tube or "My"Tube.

    I'm Going to just repost my original thoughts on this, the fact you can have a video STILL play with the song muted is retarded.

    Well yet again the Music Industry Asshats shoot themselve in the foot. You thing that after seeing several great songs taken down because of their greediness that I or any other smart person is going to buy ANY music from them again. They need to come up with a realistic way of protecting the artist AND the Fans! One is nothing without the other. Bye Bye Warner Music Group.

    My videos are created from World War II public domain videos, created by the US Government (using tax dollars) and obtained directly from the National Archives. WMG has no claim to that footage and the clips do NOT use any WMG music.

    Yet, I received WMG complains on several of them.

    That's ridiculous!

    Looks to me like WMG is flailing in the wind, trying to claim ownership of anything and everything. Clearly a dinosaur of a company in its death throes.

    Good riddance I say!

    I would strongly suggest that we all stop purchasing or using any products published by WMG. The sooner this company folds up and goes away, the better for everyone.

    I've had five videos made by myself and the four clips (that were honoured by other YouTubers with five stars, comments and more than a thousand visits) have been deleted - not just muted, entirely eliminated from my account without any prior notice!

    I do not get the point with copyright - all video footage I obtained from official YouTube publishings and the corresponding audio track from my favourite artists' CDs standing on my shelf, for which I spend money!! It really does not make any sense to forbid the YouTube world to listen to Warner Music artists!

    This procedure is embarrassing for WMG and ridiculous for all fans sharing their favourite artists' music via YouTube. I am afraid this will lead to the end of this video portal - what I find a pity! And I can only hope that a lot of people will prescind from purchasing any WMG product - to the detriment of Warner's artists! But apparently, those are the last this music group cares about!

    All persons in charge - Please reverse your decision discussed here and allow further video sharing with all the ambition and inspiration YouTube initially stood for! Otherwise this entire community is redundant!

    Fuck you, YouTube. You didn't follow your own guidelines. You removed the flash music video I spent weeks on and didn't send me a notice or even told me it was deleted due to copyright violations. I found out while trying to show someone my video. Screw you. It was a video dedicated to the artists and I am 100% sure they wouldn't mind it being made considering I sent them the video via MySpace to their band's profile with them commenting back how nice it was of me to spend the time (MY TIME) to make them a video and it was thoughtful. I don't recall them saying "SHIT. This kid made a video and it's against copyright laws! Contact YouTube! Ahhh!". The video had been up for a year now and you just now take it down. Wow... Thanks for the notice!

    I won't upload any of my videos here until this issue is clear! I'm thinking about leaving YT and deleting all of my videos! Sorry, but making vids which are removed soon after uploading is frustrating! I try to find an alternative place for my videos. I won't give up my hobby because of this and because of WMG - I bought the music legal in the store!
