I like the sound of this very much. I've had 1 video removed due to copyright infringement. It was however, a cover-song without use of any original recording. The TOS do not state whether covering a song like that is infringement, and its rather weird to see other covering channels like esmeedenters and other getting partnered, when my videos get pulled down. No hard feelings, but it does feed the thought of double standards.

I think YouTube should do something about the FLAG button so it isn't being abused. Eah user should only be able to flag a video once instead of multiple times.

Fantastic! I've been trying to point out infringing videos to people by just posting a text comment, a non-negative one I assure you, but it's all come back at my face. This would be so nice because now users can get that warning they've been wanting so badly.

Only uploading videos that contain 100% your own material (with the exception of material that the person has permission to use) has become such a lost concept. I've seen people joke as if it weren't true.

Broadcast Yourself... Not other people's work. How difficult is that to understand?

I would like to add my voice to those expressing dismay over the suspension of xenutv1 - Mark Bunker's account contained original material, interviews done by him and did not violate any aspect of YouTube policy.

He DID just yesterday post a teaser clip from an interview with the actor Jason Beghe, who left Scientology, and spoke out against them in the interview. It is well known that Scientology does not tolerate criticism against them well, and uses ANY means to silence and harass critics of the cult.

I am certain that this is a result of a flagging campaign organized by scientology, in response to the video that was getting lots of publicity, and that various news organizations were linking to - now all those links are dead, as Xenutv1 has been suspended.

It is VITAL for freedom of speech that this account be reinstated immediately.

Will you anti-Scientology folk give it a rest? You're becoming almost as annoying as Scientology itself. I'm sure Mr Xenu will be back under a new name, and the Scientology fools will shit down the account again. Its a very silly cat-and-mouse game. We know by now (well most of us) how stupid and backwards Scientology is. But the have the same right to call copyright claims as, say, Viacom.

Why have you suspended XenuTV1 and ToryMagoo44??? YouTube is all about enabling peoples voices at a profit. But do you really think that you will profit from running the errands of scientology? You are heading for a severe PR-problem since you are providing space for Co$-promotions on the starter page at the same time as you are shutting down two lovable people speaking out against bigotry and intolerance. It just looks as if you are washing Co$' dirty laundry.

Please act in the spirit of the service you are providing and at least comment on your actions.

The accounts xenutv1 and ToryMagoo44 have been suspended, even though all videos on there are 100% copyrighted to the owners of the accounts, and there isn't any kind of hate speech on there.
They have been suspended through the tireless work of the Cult of Scientology. They claim to support freedom of speech, but this is only true when the speech is positive to Scientology. ToryMagoo44 and xenutv1 is very outspoken about the evils of Scientology, and therefore they are attacked.
ToryMagoo44 was a Scientologist for 30 years, until she escaped in 2000.
xenutv1 is an emmy-award-winning filmmaker, doing videos about Scientology.

This is great, but why are random videos that contain copyrighted material (songs) are getting removed while several other videos are remaining. April 16, 2008 I just watched some of the videos, such as 'Redwall - Phenomenon' which contains a song done by Thousand Foot Krutch, and now it shows the "We're sorry, this video is no longer available." message. Is there any way someone could repost these videos with the "AudioSwap" service? Also, the video "Cluny + Vipertooth Animations: Redwall Phone" is now gone, a video I enjoyed greatly. PLEASE make a way that they could reupload these and similar videos, even if they have to have a five-second copyright notice stating the song owners. PLEASE.

How in the world did Xenutv1 violate your policies? All of Mark Bunker's videos are his own. I've read and reread your Community Guidelines, and Xenutv1 has not done any of these things. "We encourage free speech and defend everyone's right to express unpopular points of view." Do you? People are allowed to post videos on why they think atheists are wrong, or why they think religions are wrong, but when it comes to Scientology, you pull the plug on someone's account? That's not free speech, Youtube.

Please make it easier for me get an account suspended. Maybe place a button labeled "suspend account" next to each video. This would eliminate the need for me to spend hours flagging a video, I feel should not be viewed by the public, in order to get the poster of that video shut down. For example I saw a video of a person who had the audacity to say that the United States wasn't the greatest country on earth. This is not only ridiculous but it quite frankly hurt my feelings. The "suspend account" button would be a perfect solution to this type of content. Thank You.

This man has done absolutely nothing to break any of You tube's rules yet youtube betrays it's core principles so as not to upset its sponsors, by suspending this account. It's utterly disgraceful. xenutv1 will be reinstated immediately.

    YouTube is joking, right?

Mark Bunker's 1st account, xenutv was deleted from YT over a year ago for posting a Stephen Colbert video (that mocked Scientology). Without warning. Without explanation.

So yesterday, his second account, which has been up for MONTHS was suddenly deleted, again, without warning or explanation.

The only material on the new account, xenutv1, was HIS OWN, including a 3 minute snippet of an interview he recorded with Actor Jason Beghe (which was viewed over 500,000 times in a few days) in which he goes after the Cult of Scientology, of which he was a member for 12 years, with both guns blazing.

He owned the copyright on EVERY single video on xenutv1 and the hypocrites (or Scientologists) at YouTube deleted his account yesterday--and then today, YouTube posts this garbage.

I have to agree that the "muting" option makes a great deal more sense than sites going down willynilly every time some troll gets his jockeys in an uproar.

What IS needed here is a voted board of users that make reasonable decisions QUICKLY and vote so the community has a clear voice and somewhere to take their complaints for redress.

That said, under your own guidelines you need to make Mark Bunker your test case and REINSTATE HIS ACCOUNT IMMEDIATELY.

    Thank you.

You can't shut out the voice of the internet. We are your user base. We are your customers. Answering machines and form letters are not an acceptable answer to our complaints. Neither are blog entries about your policy enforcement. Bring back Xenutv1. Or face the reality that you will be hated by hundreds of thousands of users.

So, if someone who wants to supress the free-speech of others and they find a technicality in the ToS, for instance based on a DMCA request from a old deleted account, you'll still act on it because "rules are rules". No flexibility. No exceptions. Except now you'll be an infinitesimally bit less Kafkaesque about it.

    Bureaucracy at its finest.

You will restore xenutv1. This is not negotiable. You need to think very hard about who you fear more - the Cult of Scientology (which is doomed) or the geeks who PROVIDE YOUR CONTENT and therefore YOUR MONEY. Your users brought you to the top of the video sharing heap and can take you right back down.

It's a good start, but why is Xenutv1 down? As far as I can tell no terms of use were violated. He makes all of his own material, so he owns the copyright. There's no swearing or hate speech. Reinstate Xenutv1, or at least give an explanation for its suspension.
    Don't be evil.

As previously stated, Mark Bunker has a VERY large audience, an audience that makes up a large portion of your user base. Alienation of this audience will do nothing but hurt you financially in the long run.

Nice how Tom Cruise gets all chummy chummy with the head of Viacom and all of a sudden Xenutv1 gets taken down right as Mark Bunker is about to post the BIGGEST interview EVER! An interview that could even win him another Emmy. Way to go killing free speech. I thought this country was against tricks like that. We certainly didn't look kindly on the NAZIS when they did it. We will make vids to show people how to disable every Google Adsense click! You will feel it in your wallets. You say Viacom is holding up getting his account re-instated, but it is really YouTube. You make your policy, Viacom doesn't. His second account had 0, zero, null, nil violations, yet you suspended it. Why is this?

Why have you suspended Xenutv1? Scientology or others acting on their behalf are no doubt behind the unjustified flagging. That is probably what they did with ToryMagoo44 just a few a days ago, another critic. This is an organized and systematic effort of members of the cult of scientology or people paid by them to silence their critics, halt free speech, and keep the truth from getting out.

Mark Bunker of Xenutv1 is a journalist, film maker and a critic of Scientology. He interviews and films others as they speak about their own personal experiences with Scientology. The videos he posts are his own videos and are not others copyrighted materials. Criticism and personal experience is not "inappropriate content" or "bigotry".

You Tube - Please do the right thing and re-instate the Xenutv1 channel on You Tube. I will have nothing but contempt for YouTube from now on until you do the right thing.

    thank you.

The longer YouTube suspends Mark Bunker's account, Xenutv1, the longer this action will be covered in the international press. Anyone can go to LiveLink.com site hosted in the U.K. to see the same videos Mark has posted such as the one of Jason Beghe. Unlike YouTube, LiveLink actually protects freedom of expression - except when threatened by Islamic terrorists, but apparently Scientology may be just as bad, if not worse.

Scientology must really have its head stuck in your knickers.

YouTube, I object to your suspension of Mark Bunker's account, Xenutv. Why wasn't he notified? Why wasn't a reason given? If you permit someone to pressure you into suspending someone's account simply because they disagree with its content, where will it end? I submit that current political debate is far more inflammatory than anything Mark has posted on his channel. Will you also allow backers of one American presidential candidate to pressure you into suspending accounts of backers of other candidates? If YouTube lacks the integrity to stand up for free press then it may as well transform itself into a 24/7 ad channel streaming whatever one-sided garbage the group with the biggest legal team feels like trying to brainwash us with. Until Mark Bunker's channel is restored, I will not use Google or purchase anything from its advertising affiliates. Stand up, YouTube, for the future of free internet society as well as your own interests.

Before the "fix" I checked "my account" to see new comments & shared videos NOW it requires twice as many clicks to get to this information. I don't have twice as much time to devote to this task so I guess I'll just have to ignore my comments and ignore the videos shared with me.

This "Upgrade" is a serious time suck and not an improvement. I would have made this comment somewhere more relevant but.. I didn't have time to continue looking for what you don't want us to use.

Google/Youtube branding will absolutely suffer as a result of not reinstating the XENUTV1 channel.

Remember, Youtube is both a business and a conduit for freedom of expression and if Youtube is not maintained as an outlet for expression that contains critical opinion then duly mark that as the tipping point that will bring stagnation and decline as the brand becomes tarnished in the eyes of the net.

I got your fucking e-mail from "Sam". It's funny how you pricks prattle on copyright infringement when IN FACT Mark Bunker didn't commit any copyright infringement on XenuTV1. Look over his channel in your archives before you shoot off an e-mail response!

There are many accounts that are violating copy write claims. Just look at all the users that are using Colbert snippets, like the ones Mark Bunker used. Time to start eliminating many accounts. If you supposedly closed his account of Xenutv1 for using a snippet of Colbert, than why do so many other users continue to do the same thing?
Oh, but you do like that Scientology money you are getting from your Adsense program, right? I hope you lose the lawsuit Viacom is bringing against you. It will be justice. Time to scoot on over to Mr. Redstone’s place and help them.

OK, good, this is an improvement. A definite improvement. Not as good as I would like but a definite improvement.

Another sugestion; I have no problem with the "Adult Check" feature. I think that should be something the user can turn on-and-off from their end like comments and ratings. I think allot of people would, if they could, not only put the "adult Check" on their own videos to warn people about booty shaking and stuff, but also to keep the easilly offended away from controversial subjects, like Evolution, Abortion, Religion, etc.

I almost flagged my own first video (Well, technically it was my 3rd video)because I said the word "Shit" allot, I just wanted to have the adult check on, but without risking my whole account. But none of the flagging terms (at least at that time) said "mild course language" and I didn't want to alert Youtube to a video that merely contained the word "Shit" so I decided to just leave it. Hey Kids! shit! There.

I am concerned about the suspension of the billybigun64 channel. I understand that there was no notification of why he has been suspended and no communication to him regarding this slight. I have watched his channel for quite some time and have never seen anything I would consider a violation. Please reinstate is channel or at least give him the courtesy of knowing why it was suspended.

Perhaps unrelated but just as important... may I suggest someone employed by YouTube take a commanding post on your home page - many "videos being watched right now" are either violent in nature or sexually explicit. If that's what viewers are watching then that's what your website is representing to America and beyond as the YouTube image

YouTube, why on earth did you suspend the account of BILLYBOBJOE57, a 60 year old airline pilot who makes political blogs? Was it a customer complaint?

And why did you close down Xenutv1 and Torymagoo44, while simultaneously running Scientology adds. Customer complaint again?

And why suspend ChurchOfAtheism and BrettKeane? Customer complaints?

I've always been deeply against permanent suspensions. I do realize there are a few people that deserve to be gone forever. However, the vast majority of users who get suspended seem to be redeemable. On many occasions I've seen users return under new accounts. These previously suspended users will be on their very best behavior, yet they get re-suspend regardless.

In the long term I think this policy will do nothing but harm the website. Already, have I heard several people complain that this place isn't as entertaining as it used to be. Why? Because many of the people they used to watch have been barred from making videos.

Perhaps you should implement a temporary suspension strategy. Meaning that a user will be suspended for lets say 3 months. After the suspension time has expired, the computer server will automatically reinstate that person's channel. It works in everyone's best interest. The registered users are satisfied and you have more potential AD revenue. Just a thought.

All these changes fail to address the most exasperating aspect of YouTube's enforcement policy, namely the lack of explanations for why videos are removed. How can anyone avoid being a repeat offender if they don't understand what the original offense was?

The most recent example is IsobelWren05, who had 5 videos removed and no reason given (except that they supposedly violated the Terms of Service, but how?). I urge YouTube to review IsobelWren05's removed videos and either reinstate them or explain HOW they violated the Terms of Service.

    Dear folks at YouTube.

It has come to my attention that you are instating a new policy for banning people from using your service. I am very pleased to see you doing this.

You have decided to build more fairness into the system by considering the over all volume of an individuals contribution relative to their infractions. You are taking steps to ensure that a user actually receives notification when they have put up an offending video. Additionally, you have designed less harsh penalties and a way that by subsequent good behavior a user may keep out of hot water. This is all a step in the right direction.

However, I have a request left. Many users who made an impressive contribution to YouTube, members who had friends here and who were valued by the community for assorted reasons, have been permanently banned under the old system. My request is that you reinstate their accounts or at least allow them to open new accounts, unimpeded and without prejudice. Let all who apply try to get along under the new, fairer policy. If their old accounts cannot be reinstated at least let them open under a new name without any bias against them.

YouTube, I applaud your efforts at trying to be fairer. And, I thank you for your consideration of my thoughts on this.
